Lawsuit filed claiming Secretary of State Hillary Clinton is constitutionally ineligible to serve


There were serious questions about the constitutional eligibility of Hillary Clinton to serve as secretary of State. The issue arises from a vote held to raise the Secretary of States salary. Senator Hillary Clinton voted for this increase. The Constitution forbids members of the Senate from being appointed to civil office, such as the Secretary of State, if the "emoluments," or salary and benefits, of the office were increased during the Senator's term.

The truly weird part here is that I suppose we should be taking some comfort that, in these horrible times, as the world's economy heads for the worst crash in modern times and the whole Middle East teeters on the brink of explosion, that the only thing that Tinsley can find to whine about concerning the Obama administration is this gibberish.

Mallard Fillmore as a sign of hope. Surely that is a sign of the End Times.

I am willing to bet a carton of commemorative Obama juice glasses that the civil suit our heretofore anonymous troll cites will either a) get tossed out of court or, b) lose on the merits. Lawrence Tribe has addressed the question of the constitutionality of Hillary's appointment and concluded that it's okay. While Tribe is not a judge, he is about as mainstream a constitutional scholar as one can find, and I bet most courts would agree with his analysis.

On a slightly related note, I'd also point out that our heretofore anonymous troll completely biffs the actual issue. Hillary Clinton did not vote to raise the SOS salary. That was accomplished, as it always is, via Executive Order 13454 signed by former President Bush on January 8, 2008. Seep. 1486 (increasing Level I of the Executive Schedule salaries. While the emoluments for the SOS position may have been encreased, it wasn't through any action by Hillary Clinton.

Tinkley makes his attitude toward married women quite clear: you are a wife first, anything else last or not at all.

I took a moment to read the Intellectual Redneck's blog post (which in about two minutes and four mouse-click's time you can discover he spammed across a few blogs with the above post, verbatim). One of the commenters gleefully harps on challenging the legality of Obama's presidency. Truly, the only way one can become president is by losing the popular vote, possibly losing the Electoral vote and being saved by Supreme Court intervention to prevent a recount!

What this gentleman seems to be implying is that Clinton made this vote, say, on her way out of the Senate and not ALMOST SEVEN YEARS AGO. Unless she built a time machine to warn 2002 Hillary that 2008 Hillary would be named Sec. of State and needed a bigger paycheck, there was nothing sinister about this vote. When we're in economic peril and stuck in two wars without immediate end in sight, grinding the nation to a halt so the GOP can act like petulant children is reprehensible.

PROTIP: If you're going to make claims about constitutional eligibility, do your homework first.

The issue with Hillary's paycheck has happened before. Reducing the incoming appointee's salary, called a Saxbe Fix, has been used by a number of Presidents in the past with little controversy. Naturally, the Republicans just want to bring the government down along with their party.

Ah well! It's not a total loss; I appreciate SquidVicious linking to that Tribe essay, which was pretty interesting. I'll be ready elsewhere on the net when this talkin' point comes up.

Why is it always up to me to point out that Hillary didn't lose a Presidential election, but rather, somehow, through a nefarious Obamian plot, failed to become the Democratic nominee?

Isn't actually being on the ticket some sort of a prereq for actually losing the election?

Rewinn, when and where did Hillary acquire the "extensive foreign policy experience" you mention? Hillary would have never been elected to the Senate if not for the fact she is married to "Slick Willie."

Clinton has talked about how she risked her life performing foreign policy work for her husband’s administration.

She spoke of one terrifying and life threatening trip she took to Bosnia in 1995. The landing was in a “corkscrew” fashion to avoid sniper fire. Then the takeoff from the tarmac was an all out race to dodge sniper fire. She also added that,” if a place was too dangerous, too poor or too small, send the first lady.”

This is the kind of foreign policy experience you speak of? Who accompanied her on this, in her words, “life threatening mission”? The Marines? The Navy Seals? The Army Rangers? No! She was accompanied by singer Sheryl Crow and Clinton’s 15 year old daughter, Chelsea, on a goodwill mission. Is this the type of crew anyone would choose if they were really going into a life threatening situation? Does anyone believe this trip would have any more danger attached to it than a routine trip to Boise, Idaho? And this is her foreign policy experience? Her story was total bull shit.


For Christ sake the liberals were ready, backed by the Bamster, to install Princess Caroline Kennedy in this seat to replace Hillary. But after two interviews they found out the woman is a total liberal dunce!

I like to think that it warms Hillary Clinton's heart that conservatives hate her so very, very much. And then she drives home their irrelevancy by achieving things anyway.

But yes, she totally exaggerated about the trip to Bosnia. She has never been in a combat zone, which might be a serious flaw if she was Secretary of Defense. She has, however, engaged in a whole lot of policy/diplomacy work, which is considerably more important in the Secretary of State.

So hate on, anonatroll. I'm sure if you keep harping on the 90s hard enough, the GOP will totally make it back to power soon.

I'm delighted to note that TinkleyTroll still can't bring himself to admit that Clinton served on the Senate Armed Services committee.

Tinkley also has to explain away the fact that she had far more experience traveling the world, meeting foreign leaders and suchlike, than did candidate George W Bush ... who Tinkley loved as president .... because when Clinton did that she was, according to Tinkely, only a woman. What she did does not matter; what matters is that she was a wife.

Clinton's 1995 speech and diplomatic work in Beijing opened a whole new phase in international human rights ... but since its title and subject were "Women's Rights Are Human Rights" once again, it does not matter; it was only about women.

To Tinkley, she's only a girl. Mallard is single and loveless for a reason; girls have cooties!
